TERMS AGREEMENT

The following terms are hereby agreed to when placing an order for tent rental and/or tent accessories:  

Inspection:

The purpose of a site inspection is to ensure the renter and the rental company that the tent ordered will fit the renters’ needs (and space) prior to arrival at the site.  To ensure the safety of the tent erection crews and the tent renter, before a tent can be erected the following conditions must be determined (either by the rental company or the renter):

1.        Location – after the proper tent size has been determined, choose a desirable location for the tent.

a.    The minimum area required for a pole tent is 8’ in length and width more than the actual tent size.  This allows 4’ around all sides for stakes.

b.    Customer agrees to have the site clean and clear of obstacles that prevent access or installation of the equipment.  Customer agrees to an additional minimum charge of $30.00 per hour per man for any delay incurred, or additional labor performed by Joplin Tent, resulting from Customers’ negligence.  Same policies apply on the return.

c.     All deliveries and pickups are to be made on ground level.  Stairs or Elevators may result in extra charges.

d.    Joplin Tent employees are not permitted to move household furniture.

2.        Underground – It is the renter’s responsibility to locate all possible underground utilities that could be located in or around the specified area.  Customer agrees to inform Joplin Tent, in writing, of the existence of any underground pipes, cables, conduits, etc that might interfere with the ability to stake or anchor the equipment.  In the absence of such notice, Joplin Tent assumes that no underground obstructions exist.

a.     Joplin Tent is not responsible for damage to underground utilities or obstructions.

b.     Utilities could include, but not limited to water, gas, electric, telephone, sewage, etc

c.     If any utilities lay underground of the specified area, THEY MUST BE MARKED

d.    If you have any doubts or questions about any underground utilities, contact the local (or state) Utilities Protection Service.  Most utility protection services require a minimum of 48 hours notice to locate and mark underground utilities.

3.    Overhead – visually check the specified area for any and all overhead  obstructions that could possibly be in the area of the erected tent top.

a.     This includes tree limbs, branches, basketball rims, power lines, etc

Wind:
To procure necessary clearance during high winds, customer shall not:                  

a.     place anything within two feet of the top of the tent or within one foot of the sides

b.    attach fences, wires, boards, etc to the side poles of the tents that would interfere with adjusting and tightening of the tents

c.     attach any electric wires, except to the center and/or quarter poles of the tents, and then only with tape or cord, without using nails, screws or bolts

In the event that the tent or leased materials are damaged to the extent that it is unsafe, the customer shall immediately remove humans, livestock and property in the interest of safety.  In the event that the customer does not heed this warning statement, Joplin Tent will not be held liable and/or responsible for harm to human life, livestock, and/or property.

Surface:

a.     Joplin Tent will not be liable for surface damage from our trucks if drivers have to drive on the property to reach the event set up site.

b.     If tent is erected on asphalt, Joplin Tent will plug the holes, if filling is purchased, but does not warrant asphalt to be restored to original condition.

Surface is also an important issue in determining the proper type of anchor.  The use of water barrels, concrete or weights is not suggested is properly secure and anchor any tent.  Listed below are the three (3) main types of surface conditions and the standard methods of anchoring:

                1.  Grass                   Staked

                2. Asphalt                 Staked (asphalt plug available)

                3.  Concrete              Staked or Concrete anchors

Temporary Shelter:
All tents are meant as temporary shelter and must be evacuated under extreme weather conditions.  Tents are NOT guaranteed to be 100% waterproof.  

1. Although the vinyl fabrics of our tents have been treated for water repellency, they can not be guaranteed to be waterproof. 
2. No cooking is permitted in or under the tents
3. Should Joplin Tent be unable to furnish any of the listed tents, in the exact size, we reserve the right to upgrade the quality or find a substitute product.

Warranty:
Customer acknowledges that the rental property is of a size, design and capacity selected by customer and that Joplin Tent has not made and does not make an representation, warranty, or covenant, express or implied, with respect to the conditions, quality, durability or suitability of the property.

1. Joplin Tent shall not be liable to customer for any loss or damage caused directly or indirectly by the rental of property from Joplin Tent.

Reservation Policy:

1. Reservations are taken on a first come, first serve basis.
2. In order to guarantee your reservation, 20% non-refundable deposit is required at the time of booking
3. All orders are due and payable by the date of the booking unless prior credit arrangements are made in advance.

Product Damage and Cleaning Charges:

1. Customer acknowledges and agrees that they will be financially responsible for lost, missing or damaged pieces, parts and/or accessories that are rented from Joplin Tent but are not returned or returned in a damaged and/or non-rentable condition.  Joplin Tent acknowledges that damages due to acts of nature are not the responsibility of the customer.
2. Customer will be responsible for cleaning charges if products and/or tents are returned with more than customary amounts of dirt, grime, stains or dust.  Customer’s final bill will be charged cleaning charge of $30.00 per hour to restore items to a rentable condition.
3. Damaged, missing parts/pieces/items will be charged to customer’s final bill at current replacement cost for a like or similar item.

Cancellation Policy:

1. Customer agrees that in the event of an order cancellation for tents, parts, pieces, components and/or accessories that 30 days advance notice is required.
2. Cancellation of any order will result in a 20% non-refundable charge.
3. For Special Orders, payment in full is required at the time of order placement and order is non-refundable, regardless of circumstances.  
4. In the event that the customer has pre-paid for a booking and then cancelled, the refund, less the 20% non-refundable charge, will be processed and returned to the customer within 30 days.

Advertisement and Promotion:
Customer acknowledges and agrees to permission to photograph, video, or broadcast through the use of media including television, Internet, company website, etc the use any rental tent and/or accessory in future advertising.
